Please read these Terms and Conditions carefully before using the Meadow Elk Publishing website or engaging with any of our products or services. By accessing this site, creating an account, placing an order, or submitting a publishing inquiry, you agree to be bound by the terms set forth below.

Part A: General Terms and Website Use

1. Legal Entity and Definitions

Meadow Elk Publishing is operated by Meadow Elk LLC d/b/a Meadow Elk Publishing, a Texas limited liability company. Throughout these Terms and Conditions, "Meadow Elk Publishing," "MEP," "we," "us," and "our" refer to Meadow Elk LLC d/b/a Meadow Elk Publishing. The term "you" or "user" refers to any individual or organization accessing this website, placing an order, submitting materials, or engaging with any MEP product or service.

2. Acceptance of Terms

By accessing this website, creating an account, placing an order, submitting a publishing inquiry, uploading materials, or engaging with any MEP product or service, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree, do not use this website or its services.

3. Age Requirements

You may browse this website with appropriate parental or guardian supervision if you are under 18 years of age. However, you must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, place an order, submit a publishing inquiry, upload or share materials, join an author or ministry portal, or enter into any agreement with Meadow Elk Publishing.

4. Use of This Website

You agree to use this website only for lawful purposes and in a manner consistent with these Terms and Conditions. You agree that you will not use this site to violate any applicable law or regulation; transmit unsolicited advertising or spam; attempt unauthorized access to this site or its systems; impersonate any person or entity; upload viruses or harmful code; or use automated tools to access or collect site content without prior written consent.

MEP reserves the right to restrict or terminate your access to this site at any time, for conduct we determine, in our sole discretion, to be in violation of these terms or harmful to other users or third parties.

5. AI Training, Scraping, and Data Extraction

You may not use, copy, scrape, harvest, extract, or otherwise access content from this site, including text, images, metadata, product descriptions, author materials, or service descriptions, for machine learning, AI training, dataset creation, model development, or commercial data extraction, without MEP's prior written consent. This restriction applies regardless of the method or technology used.

6. Third-Party Links

This website may contain links to third-party websites for convenience or reference. MEP does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. Accessing third-party links is done at your own risk.

7. Third-Party Vendors and Fulfillment Partners

MEP may use third-party providers for payment processing, printing, fulfillment, shipping, email delivery, analytics, file storage, and distribution. MEP is not responsible for delays, errors, outages, or service interruptions caused by third-party providers, except where required by applicable law.

8. International Access

MEP operates from the United States. We make no representation that this website, its products, or services are appropriate or legally available in every jurisdiction. Users who access this site from outside the United States are responsible for compliance with applicable local laws.

9. Accessibility

Part B: Terms of Sale

10. Products and Availability

All products are subject to availability. MEP reserves the right to limit quantities, discontinue titles, correct pricing errors, or update product descriptions at any time. Format availability varies by title. In the event of a pricing error, MEP reserves the right to cancel any order placed at the incorrect price and will notify you promptly.

11. Orders and Payment

By placing an order, you represent that all information provided is accurate and that you are authorized to use the payment method submitted. All orders are subject to acceptance and availability. MEP reserves the right to refuse or cancel any order at our discretion. Prices are in US dollars. Applicable sales tax will be collected where required by law. Payment is collected in full at the time of purchase.

12. Promotional Codes and Discounts

Promotional codes are subject to individual terms and expiration dates. Only one code may be applied per order unless otherwise stated. Codes have no cash value, are non-transferable, and may not be combined with other offers unless explicitly permitted. MEP reserves the right to expire or discontinue any promotional offer at any time.

13. Shipping and Delivery

Physical orders ship within the United States only. International shipping is not currently available. Estimated delivery timelines are provided at checkout and are not guaranteed. MEP is not responsible for carrier delays or circumstances outside our control. Risk of loss passes to you upon delivery to the carrier. MEP is not liable for packages lost, stolen, or damaged after confirmed delivery.

14. Digital Products and Ebooks

Digital products are made available upon completed payment. You receive a limited, non-exclusive, non-transferable license for personal, non-commercial use only. Digital products may not be shared, resold, redistributed, or reproduced without prior written permission from MEP. Ebooks and digital products are non-returnable and non-refundable once delivered.

15. Returns and Refunds

Physical books may be returned within 30 days of purchase in unused, original condition with proof of purchase. To initiate a return, email info@meadowelkpublishing.com with your order number and reason for return. Customers are responsible for return shipping costs unless the return is due to MEP error. Approved refunds are processed within five to seven business days of receiving the returned item. Ebooks, digital products, gift cards, and custom ministry materials are non-returnable and non-refundable.

16. Preorders, Backorders, and Release-Date Changes

Preorder and release-date information is provided in good faith but may change due to printing, production, or distribution delays. If a preorder cannot be fulfilled, MEP will cancel the order and issue a full refund. MEP will notify customers of significant changes as promptly as possible.

17. Bulk and Ministry Orders

Bulk orders are available to churches, ministries, organizations, conferences, and Christian educational institutions. All bulk pricing, quantities, timelines, and payment terms are confirmed in writing prior to any bulk order. Bulk orders are non-cancellable once fulfillment has begun. Custom materials are non-refundable once approved for production. MEP reserves the right to decline bulk requests that do not align with our publishing mission or Statement of Faith.

Part C: Publishing Services Terms

18. Nature of Publishing Services

Meadow Elk Publishing offers custom-scoped publishing services to authors, pastors, and ministry leaders whose work aligns with our mission and Statement of Faith. MEP does not offer instant checkout publishing packages. All publishing engagements begin with a Publishing Inquiry and, if accepted, progress through a formal proposal and signed written agreement before any work begins.

Website pricing pages, package descriptions, and "starting at" figures are informational only. They do not constitute a binding quote, offer of services, or guarantee of pricing. Final pricing is confirmed only through a written proposal accepted by both parties.

19. Publishing Inquiry and Acceptance

Submission of a Publishing Inquiry does not constitute a publishing agreement, guarantee of acceptance, or the creation of a confidential, fiduciary, exclusive, or partnership relationship. MEP reviews every inquiry it receives and will respond if your project is a potential fit. MEP's review of an inquiry creates no obligation to publish, represent, or engage further.

MEP will use reasonable care in handling submitted materials, but no confidentiality obligation exists unless expressly stated in a separately signed non-disclosure agreement.

20. Submission Representations and Warranties

By submitting materials to MEP, you represent and warrant that you are the original creator of the content or hold all rights necessary to submit and publish it; the content does not infringe upon the intellectual property or legal rights of any third party; the content does not contain defamatory, obscene, or unlawful material; the content is consistent with biblical truth and does not contradict MEP's Statement of Faith; and you have the legal authority to enter into a publishing agreement if one is extended.

21. Limited License to Review Submitted Materials

By submitting materials, you grant MEP a limited, non-exclusive, royalty-free license to receive, store, review, evaluate, and discuss the submitted materials internally, solely for the purpose of evaluating your inquiry or potential publishing relationship. This license does not transfer ownership of your materials to MEP and does not grant MEP the right to publish or distribute your work without a separately signed written agreement.

22. Similar Themes and Independent Development

MEP serves authors and ministries across a wide range of overlapping biblical themes including prayer, discipleship, faith, leadership, devotional practice, Bible study, and sermon-based content. You acknowledge that MEP may already be developing or may later independently develop materials similar in theme, title, concept, or subject matter to materials you submit. Submission of materials does not prevent MEP from developing or publishing similar materials independently, provided MEP does not use your specific original expression without authorization.

23. Formal Publishing Agreements

All publishing relationships are formalized through a separate written agreement signed by both parties covering scope, deliverables, timeline, fees, payment schedule, rights, and all other project-specific terms. No work will begin without a fully executed written agreement and receipt of the required project commencement payment.

24. Author and Client Responsibilities

The quality and timeliness of MEP's services depend in part on the author or client meeting their responsibilities throughout the project, including: providing complete materials by agreed deadlines; responding to editorial and design feedback within agreed review windows; approving proofs and milestones in a timely manner; and making required payments on schedule. MEP is not responsible for delays caused by client inaction, late material delivery, or incomplete submissions.

25. Project Pauses, Scope Changes, and Reactivation

Projects paused at the client's request for more than 30 consecutive days may be subject to schedule reset, repricing, or a reactivation fee as outlined in the applicable written agreement. Material changes to manuscript, scope, format, or deliverables after work has begun may require a revised proposal, additional fees, or an extended timeline. MEP will communicate any such changes in writing before proceeding.

26. Ownership of Manuscripts, Deliverables, and Working Files

Authors retain ownership of their original manuscript content. Upon receipt of all required payments, final deliverable files are licensed or transferred to the author as specified in the written agreement. MEP retains ownership of its internal processes, templates, working files, source files, design concepts not selected, and production methodologies. Transfer of final deliverables does not include MEP's underlying tools or templates unless expressly stated in writing.

27. No Guarantee of Sales, Placement, or Results

Meadow Elk Publishing makes no guarantee of any specific commercial, ministry, or personal outcome. MEP does not guarantee book sales, revenue, royalties, or income; bestseller status or sales rankings; retailer, wholesaler, or distributor acceptance or placement; Amazon or platform rankings or visibility; reviews, endorsements, or media coverage; speaking opportunities or platform growth; church adoption or bulk purchases; or continued availability through any retail, distribution, or platform partner.

Distribution setup, metadata support, launch guidance, or marketing consultation does not guarantee acceptance, visibility, or commercial performance through any third-party platform or distributor.

28. Author and Ministry Account Approval

Standard customer accounts may be created for order management. Access to author portals, ministry portals, partner programs, or bulk-order account features may require separate review and approval by MEP. Approval of an account does not guarantee publication, partnership, distribution, endorsement, or continued access to any MEP program.

Part D: Submission Guidelines

29. How to Submit

Authors, pastors, and ministry leaders interested in working with MEP should begin by submitting a Publishing Inquiry through the designated inquiry form on our website. Unsolicited physical manuscripts are not accepted and will not be returned. Submissions through unofficial channels do not initiate a formal review process.

30. What to Include

A strong Publishing Inquiry includes a clear description of the message or project, the intended audience, the format you are considering, your background and ministry context, and any existing platform or distribution relationships.

31. Review Timeline

MEP reviews Publishing Inquiries as capacity allows. Submission does not guarantee a response by any specific date. We take every inquiry seriously and appreciate your patience.

Part E: Permissions and Rights

32. Permissions and Rights Requests

No material published by or through Meadow Elk Publishing may be reproduced, quoted beyond fair use, adapted, translated, distributed, included in curriculum, or incorporated into other works without prior written permission from MEP and, where applicable, the rights holder. Permissions requests must be submitted to info@meadowelkpublishing.com with a description of the material, the intended use, the distribution scope, and the requesting organization. Permission is not granted unless confirmed in writing by MEP.

33. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at info@meadowelkpublishing.com if you suspect unauthorized access. MEP reserves the right to suspend or terminate any account found in violation of these Terms.

34. Communications and Marketing

By creating an account or placing an order, you may receive transactional communications related to your purchase or account. You may opt out of marketing emails at any time by clicking the unsubscribe link in any email or contacting info@meadowelkpublishing.com.

35. Reviews, Testimonials, and Endorsements

If you submit a review or testimonial, you represent that it reflects your honest opinion and actual experience. You grant MEP a non-exclusive, royalty-free, perpetual license to use, edit for length or clarity, and publish your submission in connection with our website, products, and promotional materials. Any material connection, compensation, or benefit related to an endorsement must be disclosed where required by applicable law.

36. Intellectual Property

All content on this website, including text, articles, product descriptions, logos, graphics, images, and design, is owned by or licensed to Meadow Elk Publishing and protected under applicable copyright and trademark law. Unauthorized use is strictly prohibited. The Meadow Elk Publishing name and logo are trademarks of Meadow Elk LLC d/b/a Meadow Elk Publishing. Nothing in these Terms grants you any right to use MEP's trademarks without prior written permission.

37. Copyright Complaints

If you believe content on this website infringes your copyright, please submit a written notice to info@meadowelkpublishing.com with the subject line "DMCA Notice" including: a description of the copyrighted work; the URL where the alleged infringement appears; your contact information; a good-faith statement that the use is not authorized; a statement under penalty of perjury that your information is accurate; and your signature. MEP will respond to valid notices promptly and reserves the right to terminate accounts of repeat infringers.

38. Privacy

Your use of this website is also governed by MEP's Privacy Policy, incorporated into these Terms by reference. By using this site, you consent to the collection and use of your information as described in the Privacy Policy.

39. Indemnification

You agree to indemnify, defend, and hold harmless Meadow Elk LLC d/b/a Meadow Elk Publishing and its owners, officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney fees, arising from your use of this website, your violation of these Terms, materials you submit, or your infringement of any third-party rights.

40. Disclaimer of Warranties

This website and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. MEP does not warrant that the site will be uninterrupted, error-free, or free from harmful components. Your use of this website is at your sole risk.

41. Limitation of Liability

To the fullest extent permitted by applicable law, Meadow Elk LLC d/b/a Meadow Elk Publishing and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website or any products or services purchased through it. MEP's total aggregate liability for any claim shall not exceed the total amount paid by you to MEP in the six months preceding the claim.

42. Force Majeure

MEP shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of God, war, civil unrest, government action, supply chain disruptions, power failures, internet outages, or third-party vendor failures.

43. Dispute Resolution

MEP encourages you to contact us first at info@meadowelkpublishing.com to resolve any concern informally. If a dispute cannot be resolved informally within 30 days of written notice, any claim arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Texas. You waive any right to a trial by jury and agree not to participate as a class member in any class action proceeding. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property rights or prevent irreparable harm.

44. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas, without regard to its conflict of law provisions. To the extent arbitration does not apply, you submit to the exclusive jurisdiction of the state and federal courts located in Texas.

45. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

46. Entire Agreement

These Terms and Conditions, together with MEP's Privacy Policy and any separately signed publishing services agreements, constitute the entire agreement between you and Meadow Elk LLC d/b/a Meadow Elk Publishing and supersede all prior communications or agreements regarding the same subject matter.

47. Changes to These Terms

MEP reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated Last Updated date. Continued use of the website following any update constitutes your acceptance of the revised terms.
